These Terms of Service govern your access to and use of the Mediterraluxe online store operated via Shopify. By visiting, browsing or purchasing through this website you agree to be bound by these Terms. Please read them carefully before making a purchase.

Overview
Welcome to Mediterraluxe. The terms “we”, “us” and “our” refer to Mediterraluxe, a business owned and operated by Karina M. Schembri, registered at 108 Triq Il-Ħuttaf, Mosta, MST 4604, Malta (VAT: MT32519332). Mediterraluxe operates this online store and website, including all related information, content, features, products and services (the “Services”), powered by Shopify Inc.
These Terms of Service, together with our Privacy Policy, Shipping Policy, and Refund & Quality Policy, govern your rights and responsibilities when using the Services. By accessing or using our website you confirm that you have read, understood and agreed to these Terms.
Section 1 — Access & Account
By agreeing to these Terms you confirm that you are at least the age of majority in your state, province or country of residence. You accept responsibility for any use of the Services on devices you own or manage, including by minor dependents.
To use the Services you may be required to provide personal information including your name, email address, billing, payment and shipping details. You represent and warrant that all information provided is accurate, current and complete and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign or license your account to any other person.
Section 2 — Our Products
Mediterraluxe designs and sells baroque botanical print-on-demand home decor textiles. Every product is made to order, individually produced at the time of purchase through our printing partner. This is a deliberate part of the Mediterraluxe philosophy: we produce nothing without a home to go to, eliminating overstock and reducing waste.

All Mediterraluxe designs are original compositions created by Karina M. Schembri using AI-assisted design tools. All intellectual property rights in these designs vest exclusively in Karina M. Schembri trading as Mediterraluxe.

We have made every effort to present our products accurately. However, colors and product appearance may differ from how they appear on your screen due to your device settings, display calibration and monitor type. We do not warrant that the appearance or quality of any product will precisely match what is depicted on screen.
All product descriptions are subject to change at any time without prior notice. We reserve the right to discontinue any product and to limit quantities available to any person, geographic region or jurisdiction at our sole discretion.
Section 3 — Orders
When you place an order you are making an offer to purchase. Mediterraluxe reserves the right to accept or decline any order at its sole discretion. Your order is not accepted until we confirm acceptance and successfully process your payment.
Please review your order carefully before submitting. As all products are made to order, Mediterraluxe may be unable to accommodate cancellation requests once an order is accepted and production has commenced. In the event that we decline, modify or cancel your order, we will notify you by email at the address provided at checkout.
Your purchases are subject to our Refund & Quality Policy. You represent and warrant that all purchases are for your own personal or household use and not for commercial resale or export.
Section 4 — Prices & Billing
All prices are displayed in the currency shown at checkout. Prices, promotions and discounts are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as set out in your order confirmation email.
Unless otherwise stated, prices do not include applicable taxes, customs duties, import charges or shipping costs. These will be calculated and displayed at checkout where applicable.
You agree to provide accurate, current and complete payment information for all purchases. You represent and warrant that: (i) the payment information you provide is true, correct and complete; (ii) you are authorized to use the payment method provided; (iii) charges incurred will be honored by your payment provider; and (iv) you will pay all charges including shipping and applicable taxes.
We may offer promotions governed by separate terms. Where a conflict exists between promotion terms and these Terms, the promotion terms shall prevail.
Section 5 — Shipping & Delivery
All Mediterraluxe orders are dispatched within 2–5 business days of purchase. This production window reflects the time required to individually manufacture your item. All orders are shipped via DHL courier with full end-to-end tracking. You will receive a shipping confirmation email including your DHL tracking number once your order has been dispatched.
Mediterraluxe ships worldwide. Orders are fulfilled from the printing facility nearest to your delivery address, with facilities located in the United States, European Union and Australia. All orders are dispatched in sustainable, minimal packaging.

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing or events outside our control. Once your order has been transferred to DHL, title and risk of loss pass to you. International orders may be subject to customs duties and import taxes, which are the responsibility of the buyer.
Section 6 — Refund & Quality Policy
All Mediterraluxe products are made to order. In line with our commitment to sustainable, conscious production, we do not accept returns or exchanges for change of mind, incorrect size selection or personal preference.

We stand fully behind the quality of every Mediterraluxe product. If your item arrives defective, damaged or incorrectly printed, we will replace it or refund it in full.

Quality Guarantee — How to Submit a Claim
To submit a quality or defect claim, please follow these steps:
• Email hello@mediterraluxe.com with the subject line: Quality Claim — Order #[your order number]
• Attach a minimum of 3 clear photographs showing the defect or damage
• Your claim must be submitted within 3 calendar days of confirmed delivery
Claims submitted after 3 days of confirmed delivery or without the minimum 3 images cannot be processed. Approved claims will be resolved by replacement or full refund to your original payment method within 10 business days.
European Union — 14-Day Cooling-Off Period
If your order is being delivered within the European Union, you have the right to cancel or return your order within 14 calendar days of receiving it, without providing a reason, in accordance with the EU Consumer Rights Directive. Contact us at hello@mediterraluxe.com within 14 days of delivery to exercise this right. Return shipping costs are the responsibility of the buyer unless the item is defective. Refunds will be processed within 10 business days of receiving the returned item in its original condition.
Section 7 — Intellectual Property
The trademark “Mediterraluxe” is a registered trademark of Karina M. Schembri. All content published on this website — including product designs, images, graphics, text, patterns and visual compositions — is the original intellectual property of Mediterraluxe and is protected under applicable Maltese, European Union and international intellectual property laws.
All Mediterraluxe designs are original compositions created by Karina M. Schembri. Ownership of all original works rests exclusively with Karina M. Schembri trading as Mediterraluxe, regardless of the tools or technologies used in their creation.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publish, download, store or transmit any content from the Services without our prior written consent. All rights not expressly granted herein are reserved by Mediterraluxe.
Section 8 — Optional Tools & Third-Party Links
The Services may include access to optional tools provided by third parties. These tools are provided “as is” without warranties of any kind. We are not responsible for and have no liability in connection with your use of any third-party tools. Any use of optional tools is entirely at your own risk.
The Services may contain links or references to third-party websites. We are not responsible for the content, accuracy or practices of any third-party website. Accessing third-party websites is at your own risk and subject to their terms and privacy policies.
Section 9 — Relationship with Shopify

This section accurately characterizes Shopify’s relationship with your store and should not be removed or modified.

Mediterraluxe is powered by Shopify Inc., 151 O’Connor Street, Ground Floor, Ottawa, Ontario, K2P 2L8, Canada. All sales and purchases made through this store are made directly with Mediterraluxe. By using the Services you acknowledge and agree that Shopify is not responsible for any aspect of any transaction between you and Mediterraluxe, including any injury, damage or loss resulting from purchased products. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Mediterraluxe.
Section 10 — Privacy & Data Protection (GDPR)
Mediterraluxe is committed to protecting your personal data in full compliance with Regulation (EU) 2016/679 (the General Data Protection Regulation — GDPR). All personal information collected through the Services is processed solely for the purposes of order fulfilment, customer communication and service improvement.
As a data subject you have the following rights at any time:
• Right to access the personal data we hold about you
• Right to rectification of inaccurate data
• Right to erasure (“right to be forgotten”)
• Right to restriction of processing
• Right to data portability
• Right to object to processing
To exercise any of these rights, contact us at hello@mediterraluxe.com. You also have the right to lodge a complaint with the competent supervisory authority — in Malta, this is the Information and Data Protection Commissioner (IDPC) at idpc.org.mt.
The Services are hosted by Shopify, which processes personal information in order to provide and improve the platform. Information submitted through the Services will be shared with Shopify and may be transmitted to third parties in other countries. Section 11 — Feedback & Reviews
If you submit, upload, post or otherwise transmit any ideas, suggestions, feedback, reviews or proposals (collectively “Feedback”), you grant Mediterraluxe a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish and distribute such Feedback for any purpose, including to operate and improve the Services.
You represent and warrant that you own or have all necessary rights to all Feedback submitted and that your Feedback complies with these Terms and does not infringe the rights of any third party. We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, defamatory or otherwise objectionable.
Section 12 — Errors, Inaccuracies & Omissions
Occasionally information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any errors or inaccuracies and to change or update information at any time without prior notice, including after you have submitted an order.
Section 13 — Prohibited Uses
You may access and use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any applicable law or regulation; (c) to infringe our intellectual property rights or those of any third party; (d) to harass, harm or defame any person; (e) to transmit false or misleading information; (f) to transmit spam, chain letters or unsolicited commercial communications; (g) to impersonate any person or entity; or (h) in any manner that could harm Mediterraluxe, Shopify or other users of the Services.
You further agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, sell or exploit any portion of the Services; (c) collect or track personal information of others; (d) spam, phish, scrape or crawl the Services; or (e) interfere with or circumvent the security features of the Services. We reserve the right to suspend or terminate your account for any violation of these prohibitions.
Section 14 — Termination
We may terminate this agreement or your access to the Services at any time without notice at our sole discretion. You will remain liable for all amounts due up to and including the date of termination. The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any provisions that by their nature should survive.
Section 15 — Disclaimer of Warranties
Except as expressly stated by Mediterraluxe, the Services and all products offered through the Services are provided “as is” and “as available” without any representation, warranty or condition of any kind, either express or implied, including all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title and non-infringement.

Nothing in these Terms affects your statutory rights under applicable EU or Maltese consumer protection law. All statutory guarantees afforded to consumers under the EU Consumer Rights Directive and related legislation are fully preserved.

Section 16 — Limitation of Liability
To the fullest extent permitted by applicable law, Mediterraluxe, its partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, loss of data, replacement costs or similar damages, arising from your use of the Services or any products purchased through the Services.
Section 17 — Indemnification
You agree to indemnify, defend and hold harmless Mediterraluxe, Karina M Schembri, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising from: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.
Section 18 — Governing Law & Disputes
These Terms of Service and all matters relating to your use of the Services are governed by the laws of Malta and, where applicable, the laws of the European Union, including the EU Consumer Rights Directive, the General Data Protection Regulation (GDPR) and applicable e-commerce regulations.
Any disputes arising in connection with these Terms or any purchase made through the Services shall be subject to the jurisdiction of the competent courts of Malta.
EU customers who are unable to resolve a dispute directly with Mediterraluxe may refer the matter to the Malta Competition and Consumer Affairs Authority (MCCAA) or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Section 19 — General Provisions
Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by law and the unenforceable portion shall be severed. The validity and enforceability of all remaining provisions shall not be affected.
Waiver & Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy, Shipping Policy and Refund & Quality Policy, constitute the entire agreement between you and Mediterraluxe and supersede all prior agreements and communications.
Assignment
You may not delegate, transfer or assign these Terms or any of your rights or obligations without our prior written consent. We may transfer or assign these Terms and our rights without consent.
Changes to These Terms
We reserve the right to update or change these Terms at any time by posting updates on this page. Material changes will be communicated in accordance with applicable law. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
